AN EMERGENCY RESOLUTION DESIGNATING CERTAIN BUILDING AT 208 MAIN STREET, KILLBUCK, TO BE A VACANT BUILDING AS DEFINED IN VILLAGE OF KILLBUCK ORDINANCE 2016-01, AND DECLARING AN EMERGENCY
WHEREAS, the Village of Killbuck Ordinance No. 2016-01 provides in Section 2(f) thereof that upon receipt of reports and photographs of a suspected Vacant Building the Village of Killbuck shall review, and if deemed appropriate, shall memorialize by passing a resolution, that the building in question meets the criteria of a Vacant Building;
NOW THEREFORE, be it ordained by the Council of the Village of Killbuck, a majority of all Council members concurring that:
SECTION 1: The reports and any photographs of the property located at 208 Main Street, Killbuck, Ohio, Holmes County, Ohio Tax Parcel No. 0900160000 have been received and reviewed by the Village of Killbuck Council.
SECTiON 2: Upon review of the reports and photographs noted in Section 1 hereof, in conjunction with their review, a majority of the members of the Village Council have determined that the property in question meets the definition of a Vacant Building pursuant to Ordinance 2016-01.
SECTION 3: This Resolution shall be determined to be the findings of the Village of Killbuck Council that the property located at 208 Main Street, Killbuck, Ohio, Holmes County, Ohio Tax Parcel No. 0900160000 is hereby designated to be a Vacant Building subject to the provisions of Ordinance 2016-01.
SECTION 4: It is found and determined that all formal actions of this Council concerning and relating to the passage of this Resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, including but not limited to Section 121.22 of the Ohio Revised Code.
SECTION 5. This resolution is hereby declared to be an emergency to be found in the best interest of the residents of the Village of Killbuck, Ohio, and more particularly to protect the health and welfare and safety of the citizens of the Village. This Resolution shall take effect on the date hereof.
Passed at a regular meeting of the Killbuck Village Council duly convened with a quorum present this 7th day of September, 2021.
