AN ORDINANCE AUTHORIZING THE MAYOR AND FISCAL OFFICER TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF KILLBUCK AND W.E. QUICKSALL AND ASSOCIATES, INC. FOR ENGINEER SERVICES FOR THE VILLAGE OF KILLBUCK OPWC ROUND 36 STREET IMPROVEMENT PROJECT, AND DECLARING AN EMERGENCY
WHEREAS, the Village of Killbuck submitted an application to the Ohio Public Works Commission (“OPWC”) for financial assistance for paving of various streets and alleys within the Village of Killbuck and storm sewer improvements on Grant Street (the “OPWC Round 36 Street Improvement Project”);
WHEREAS, OPWC awarded the Village of Killbuck certain funding for the OPWC Round 36 Street Improvement Project; and
WHEREAS, the Village of Killbuck desires to utilize W.E. Quicksall and Associates, Inc. (“Quicksall”) for engineer services for the OPWC Round 36 Street Improvement Project, and Quicksall has agreed to provide engineer services as set forth in the attached Short Form of Agreement Between Owner and Engineer for Professional Services, which Agreement was drafted by Quicksall.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the Village of Killbuck, Holmes County, Ohio:
SECTION 1. Council hereby authorizes the Mayor and Fiscal Officer to sign the attached Short Form of Agreement Between Owner and Engineer for Professional Services
on behalf of the Village of Killbuck. Pursuant to the Agreement, the Village shall pay Quicksall $47,900 for Basic Services, and $9,400.00 for Resident Project Representative Services for engineering services provided by Quicksall for the OPWC Round 36 Street Improvement Project.
SECTION 2. This Ordinance is hereby declared to be an emergency measure, necessary for the immediate preservation of the public peace, health, or safety, for the reasons that the Village needs to immediately utilize the services of Quicksall for the OPWC Round 36 Street Improvement Project to proceed, and this Ordinance is necessary to provide full authority for the Mayor and Fiscal Officer to sign the Agreement.
SECTION 3. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
