AN ORDINANCE AUTHORIZING THE MAYOR AND FISCAL OFFICER TO EXECUTE AMERICAN ELECTRIC POWER EASEMENTS CONCERNING HOLMES COUNTY PARCEL NO. 0900137000 AND DECLARING AN EMERGENCY
WHEREAS, American Electric Power (“AEP”) is constructing upgrades to its electric distribution and/or transmission system and facilities in and around the Village of Killbuck, Ohio, which upgrades will benefit Sperry Rice & Holdings Killbuck, LLC (“Sperry Rice”), a company located in the Village of Killbuck, by allowing the existing underground electric distribution facilities to be extended to Sperry Rice;
WHEREAS, in connection with said upgrades, AEP provided the Village with one (1) document, titled “Easement & Right of Way,” concerning Holmes County Parcel No. 0900137000, owned by the Village of Killbuck (the “Property”), to be executed by the Village (the “Easements”); and
WHEREAS, Council wishes to formalize the aforementioned approval of the Easements by Ordinance, including placement of the facilities on the Property, and ratify and y approve the execution of the Easement.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the Village of Killbuck, Holmes County, Ohio:
SECTION 1. Council does hereby ratify and authorize the Mayor and Fiscal Officer to sign the Easement on behalf of the Village of Killbuck and authorizes and approves the location of said underground electric distribution extension under the Property.
SECTION 2. This Ordinance is hereby declared to be an emergency measure, necessary for the immediate preservation of the public peace, health, or safety, for the reasons that the Easement relate to an impending update to certain electric facilities by AEP, which upgrade will presumably benefit the local community and Sperry Rice, and this Ordinance is necessary to provide full authority for the Mayor and Fiscal Officer to sign the required Easements.
SECTION 3. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
