AN ORDINANCE TO MAKE APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE VILLAGE OF KILLBUCK, STATE OF OHIO, DURING THE FISCAL YEAR ENDING DECEMBER 31, 2021, AND DECLARING AN EMERGENCY

SECTION 1. BE IT ORDAINED by the Council for the Village of Killbuck, State of Ohio, that, to provide for the expenditures and contingencies of the Village of Killbuck during the year ending December 31, 2021, the amounts set forth on the attached exhibit be and they are hereby set aside and appropriated as set forth therein.

SECTION 2. The Village Fiscal Officer is hereby authorized to draw warrants on the Village Treasury for payments from any of the appropriations set forth in the attached upon receiving proper certificates and vouchers therefore, approved by the board or officers authorized by law to approve the same, or an ordinance or resolution of council to make the expenditures; provided that no warrants shall be drawn or paid for salaries or wages except to persons employed by authority of and in accordance with law or ordinance. Provided further that the appropriations for contingencies can only be expended upon appeal of two-thirds vote of Council for items of expense constituting a legal obligation against the Village, and for purposes other than those covered by the other specific appropriations herein made.

SECTION 3. This Ordinance is hereby declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency is that this Ordinance is necessary for the immediate preservation of public peace, health, safety and welfare, and for the further reason that immediate passage is necessary to maintain correct accounting practices, to pay the current and imminent financial obligations of the Village, and to prevent expenditures from exceeding appropriations. This Ordinance shall take effect at the earliest period allowed by law.

SECTION 4. All prior ordinances which conflict with the provisions of this Ordinance are hereby repealed to the extent that they are in conflict herewith.

SECTION FOUR. If any provision of this Ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions are severable.
