AN ORDINANCE AUTHORIZING THE MAYOR AND FISCAL OFFICER TO SIGN A CONTRACT WITH THE HOLMES COUNTY PROSECUTING ATTORNEY’S OFFICE FOR CERTAIN PROSECUTORIAL SERVICES, AND DECLARING AN EMERGENCY 

WHEREAS, the Village Council recognizes there can be local benefits to the Village and/or the Holmes County Sheriff’s Office charging traffic, criminal, and general offenses under Village Ordinances in the Holmes County Municipal Court, and 

WHEREAS, the Village wants these ordinance-charged offenses to be prosecuted in court in the least costly manner, and 

WHEREAS, the office of the Holmes County Prosecuting Attorney is willing to provide these services to the Village at a discounted fee of $50.00 per hour. 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the Village of Killbuck, Holmes County, Ohio:

SECTION 1.  The Village Council hereby authorizes the Mayor and Fiscal Officer to enter into a contract with the office of the Holmes County Prosecuting Attorney to provide the above-referenced prosecutorial services in the Holmes County Municipal Court on behalf of the Village for $50.00 per hour.  

SECTION 2.  This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public health, safety, and welfare because cases requiring  prosecution may be filed at any time. For that reason, this Ordinance shall be immediately effective upon proper passage by Council.

SECTION 3. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
