AN ORDINANCE DETERMINING LOWEST AND BEST BID FOR THE PARK IMPROVEMENT PROJECT CONSTRUCTION CONTRACT AND AUTHORIZING THE MAYOR AND FISCAL OFFICER TO EXECUTE A CONSTRUCTION CONTRACT WITH MELWAY PAVING CO., AND DECLARING AN EMERGENCY

WHEREAS, pursuant to its contract with the Village of Killbuck, W.E. Quicksall and Associates, Inc. (“Quicksall”) is providing engineer services for the Village of Killbuck Park Improvement Project (the “Park Improvement Project”);

WHEREAS, the Park Improvement Project consists of approximately 1,200 square yard of new asphalt parking lot, replacement of one basketball hoop, removal of two existing basketball hoops, approximately 150 square feet of 4-inch-thick concrete sidewalks, and various pavement markings;

WHEREAS, the Village advertised the Park Improvement Project construction contract for bids; and

WHEREAS, Quicksall analyzed the bid documents received and recommends that the Park Improvement Project construction contract be awarded to Melway Paving Co., Inc., in the amount of $60,380.60.

NOW, THEREFORE, BE IT ORDAINED, by the Council of the Village of Killbuck, Holmes County, Ohio:

SECTION 1. Council hereby accepts the recommendation of Quicksall, and determines that the bid of Melway Paving Co., Inc. for the Park Improvement Project construction contract is the lowest and best bid received after advertising.

SECTION 2. Council hereby authorizes the Mayor and Fiscal Officer to enter into a Construction Contract on behalf of the Village of Killbuck with Melway Paving Co., Inc. for the Park Improvement Project construction work, in accordance with the specifications upon which the bid was received.

SECTION 3. The cost of the Park Improvement Project Construction Contract, in the amount of $60,380.60, shall be paid pursuant to the Construction Contract terms out of funds appropriated by Council. $60,380.60 is hereby appropriated from the Park Fund (2041), to pay the cost of the Construction Contract for the Park Improvement Project.

SECTION 4. This Ordinance is hereby declared to be an emergency measure, necessary for the immediate preservation of the public peace, health, or safety, for the reasons that the Village needs to proceed with the construction work for the Park Improvement Project, and this Ordinance is necessary to provide full authority for the Mayor and Fiscal Officer to sign the relevant Construction Contract.

SECTION 5. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
