AN ORDINANCE AUTHORIZING THE MAYOR AND/OR FISCAL OFFICER TO EXECUTE AN OHIO PUBLIC WORKS COMMISSION PROJECT LOAN AGREEMENT AND PROMISSORY NOTE FOR THE MULTIPLE STREETS IMPROVEMENTS PROJECT, AND DECLARING AN EMERGENCY

WHEREAS, the Ohio Public Works Commission has agreed to loan the Village of Killbuck $321,613.00 to finance the project costs for the Village of Killbuck Multiple Streets and Improvements Project, pursuant to the terms and conditions of the Project Loan Agreement and Promissory Note dated July 1, 2022 between the State of Ohio, acting by and through the Director of the Ohio Public Works Commission, and the Village of Killbuck Ohio;

WHEREAS, the scope of the Multiple Streets and Improvements Project consists of the replacement of the sidewalk on School Street with a 4-inch concreate walk; replacement of catch basins on Grant Street; and chip and seal of various streets and alleys with partial depth payment repair as required.  

NOW, THEREFORE, BE IT ORDAINED, by the Council of the Village of Killbuck, Holmes County, Ohio:

SECTION 1.  Council hereby approves the Project Loan Agreement and Promissory Note dated July 1, 2022 between the State of Ohio, acting by and through the Director of the Ohio Public Works Commission, and the Village of Killbuck Ohio, for the Multiple Streets and Improvements Project, and authorizes the Mayor and/or Fiscal Officer to execute the Project Loan Agreement and Promissory Note on behalf of the Village of Killbuck.

SECTION 2.  This Ordinance is hereby declared to be a retroactive emergency measure, necessary for the immediate preservation of the public peace, health, or safety, for the reason that Project Loan Agreement and Promissory Note are dated and effective July 1 2022, and this Ordinance is necessary to provide full authority for the Mayor and/or Fiscal Officer to sign the Project Loan Agreement and Promissory Note. 

SECTION 3. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
