AN ORDINANCE TO AMEND ORDINANCE NO. 2021-18 TO INCLUDE BEREAVEMENT LEAVE, AND DECLARING AN EMERGENCY

WHEREAS, the Council of the Village of Killbuck wishes to grant each full-time permanent and part-time permanent employee three consecutive working days of bereavement leave with pay upon the death of a member of the employee’s immediate family as set forth herein, effective January 1, 2022.

NOW, THEREFORE, BE IT ORDAINED, by the Council of the Village of Killbuck, Holmes County, Ohio:

SECTION 1. Council hereby amends Section 5 (“Other Benefits”) of Ordinance No. 2021-18 to add a bereavement leave benefit as Section (E), effective January 1, 2022, which shall read as follows:

(E) Each full-time permanent and part-time permanent employee shall be granted three consecutive working days of bereavement leave with pay upon the death of a member of the employee’s immediate family. Bereavement leave shall not exceed twenty-four scheduled work hours. Compensation for bereavement leave shall be equal to the employee’s base rate of pay. Part-time permanent employees shall be granted bereavement leave based on the number of hours they would have normally been scheduled to work.

SECTION 2. All other provisions of Ordinance No. 2021-18 shall remain in full force and effect. All prior ordinances or resolutions or any part thereof, which are inconsistent with this Ordinance are hereby repealed as to the inconsistent parts therefore and the remainder of said ordinances or resolutions not inconsistent with this Ordinance shall remain in full force and effect.

SECTION 3. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. This Ordinance is hereby declared to be a retroactive emergency measure necessary for the immediate preservation of the public peace, health, and safety, such emergency arising from the need to provide the benefit to employees effective January 1, 2022 to compensate employees for unplanned time off work in 2022 due to death of immediate family members of employees. Accordingly, this Ordinance shall be in full force and effect effective January 1, 2022.
