VILLAGE OF KILLBUCK, OHIO ORDINANCE NO. 2024-003 PROVIDING FOR THE EMPLOYMENT OF A LEGAL ADVISOR FOR THE VILLAGE OF KILLBUCK, AND DECLARING AN EMERGENCY
BE IT ORDAINED by the Council of the Village of Killbuck, State of Ohio:
SECTION l. That legal counsel shall be provided for this Village, and the Mayor and Fiscal Officer are hereby authorized to execute a contract, in the form attached hereto, with legal counsel for the legal services to be rendered to the Village for the term January 17, 2024 through January 16, 2026, a two-year period, in accordance with Section 733.48 of the Ohio Revised Code.
SECTION 2. The rates for said services shall be enumerated in said contract and shall be payable monthly.
SECTION 3. The legal counsel shall be an attorney at law, admitted to practice in the courts of Ohio. It shall be the duty of said legal counsel to act as attorney and counsel for the Village and the officers thereof in their official capacity, as such attorney, to prosecute and defend all actions by or against the Village or any department or officer thereof during the term of her contract; to render legal opinions to the Council and to any department or officer of the Village upon request; and to perform other legal services as the Ohio Revised Code may require of a Village Solicitor or legal counsel for a village.
SECTION 4. This Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health and safety, and it shall be effective January 17, 2024, upon its passage. The reason for the emergency is that Council and its officers have been and are in continuing need of legal services for the purpose of carrying out their respective responsibilities in accordance with law.
