A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY AUDITOR, AND DECLARING AN EMERGENCY
WHEREAS, Council, in accordance with the provisions of law, has previously adopted a Tax Budget for the next fiscal year commencing January 1, 2022; and
WHEREAS, the Budget Commission of Holmes County, Ohio has certified its action thereon to this Council together with an estimate by the County Auditor of the rate of each tax necessary to be levied by this Council, and what part thereof is without, and what part within, the Ten Mill limitation; and
WHEREAS, Council finds that after reviewing the determinations made by the Budget Commission, acceptance of the same would be in the best interests of the health, safey, and welfare of the citizens of the Killbuck, Ohio.
NOW THEREFORE, BE IT RESOLVED by the Council of the Village of Killbuck, Ohio, two thirds or more of the members elected thereto concurring that:
SECTION ONE: The amounts and rates, as determined by the Budget Commission in its certification, be and the same are hereby accepted.
SECTION TWO: There is hereby levied on the tax duplicate of the Village of Killbuck the rate of each tax necessary to be levied within and without the Ten Mill limitation as set forth in the attached Schedules which are made a part of this Resolution by Reference.
SECTION THREE: The Fiscal Officer of the Village of Killbuck is directed to certify a copy of this Resolution to the Holmes County Auditor.
SECTION FOUR: It is found and determined that all formal actions of the Council of the Village of Killbuck concerning and relating to the adoption of this Resolution were taken in an open meeting of the Council of the Village of Killbuck and that all deliberations of Council and any of its committees that resulted in those formal actions were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION FIVE: This Resolution is hereby declared to be an emergency measure and shall take effect and be in force immediately from and after its passage. The reason for the emergency is that this Resolution is necessary for the immediate preservation of public peace, health, safety and welfare, and for the further reason that it is necessary to accept the tax levies as certified by the County Auditor in compliance with the Ohio Revised Code and to timely deliver this Resolution to the County Auditor.
SECTION SIX: All prior resolutions which conflict with the provisions of this Resolution are hereby repealed to the extent that they are in conflict herewith.
SECTION SEVEN: If any provision of this Resolution, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of this Resolution which can be given effect without the invalid provision or application, and to this end the provisions are severable.
Passed at a regular meeting of the Killbuck Village Council duly convened with a quorum present this 7 day of September, 2021.
